Supreme Court Won't Review Mariner East Pipeline Challenge

Law360 (June 4, 2018, 3:32 PM EDT) -- The U.S. Supreme Court on Monday declined to review a challenge to a Sunoco Inc. unit’s ability to use eminent domain to demand a right of way for the construction of the Mariner East 2 pipeline in Pennsylvania, cementing a ruling in the company’s favor.

Monday's order keeps in place a May 2017 ruling by a three-judge panel of the Pennsylvania Commonwealth Court against a Lebanon County landowner. The panel had agreed that Sunoco Pipeline LP, which aimed to build the 350-mile Mariner East 2 pipeline along a route of a repurposed pipeline, was a valid public utility with eminent domain...
