9th Circ. Reopens Bellagio Hotel's 'Fat Shaming' Sign Suit

Law360 (July 19, 2018, 7:10 PM EDT) -- The Ninth Circuit on Wednesday revived a former Bellagio Hotel and Casino server's claim that he suffered emotional distress when his supervisors at a now-closed restaurant in the Las Vegas hotel failed to take down a sign that called him fat.

The panel handed a win to Andi Kraja when it found that the hotel management's failure to remove the sign, which read "Fat Andy" and was posted in a public area behind locked glass, could be considered "extreme and outrageous conduct" under Nevada law. The...
