Defendants' Experts Allowed In Stand 'N Seal MDL

Law360, New York (June 16, 2009, 12:00 AM EDT) -- Dealing a blow to plaintiffs in the multidistrict product liability litigation over Stand ‘n Seal, a federal judge is allowing testimony from the defendants' experts that undercuts claims the spray-on sealant’s use of the chemical Flexipel caused respiratory problems.

Judge Thomas W. Thrash of the U.S. District Court for the Northern District of Georgia ruled Monday that testimony from three doctors that contend Stand ‘n Seal does not emit sufficient amounts of the chemical plaintiffs allege caused their injuries, including chemical pneumonitis.
