Merck Scores Second Win In Vioxx Onslaught

Law360 (September 27, 2006, 12:00 AM EDT) -- Merck & Co. said late Tuesday that a jury had cleared the company of responsibility for a Kentucky man's heart attack, marking the company’s second federal win in the slew of litigation it faces over its painkiller Vioxx.

Merck said a New Orleans jury had found that Vioxx was not the cause of Robert Smith’s 2003 death. The 56-year-old suffered a heart attack after taking the drug for approximately four months.
