No Fair Use For 'Catcher' Spinoff: Court

Law360, New York (July 1, 2009, 12:00 AM EDT) -- Perhaps closing the book on the U.S. publication of a novel based on J.D. Salinger’s “The Catcher in the Rye,” a federal judge has issued a preliminary injunction on the derivative work, ruling that it violates Salinger’s copyrights.

Judge Deborah A. Batts of the U.S. District Court for the Southern District of New York issued a preliminary injunction Wednesday, ruling after an exacting reading of the books that the new novel fails to sufficiently transform the original or otherwise make fair use of Salinger’s copyrights....
