Workers Comp Bars Rig Injury Suit, Texas Appeals Court Says

Law360 (October 30, 2018, 9:22 PM EDT) -- A Texas appeals court on Monday upheld a lower court's decision to toss a burned and blinded oil rig worker's personal injury suit against his employer, finding that the Texas Workers Compensation Act bars him from bringing a negligence claim.

The Sixth Court of Appeals in Texarkana upheld a Smith County Court-at-Law decision granting summary judgment in favor of Mewbourne Oil Co. in a dispute over injuries William Lentz suffered in a 2015 explosion, finding that the employer protections in the Texas Workers Compensation Act shield the oil company from his personal injury claims.
