Circuit Court Revives RICO Claims In Illegal Worker Case

Law360 (September 29, 2006, 12:00 AM EDT) -- On remand from the U.S. Supreme Court, a federal appeals court has revived racketeering charges against a multi-billion dollar carpet manufacturer accused of hiring illegal immigrants to depress wages for thousand of legal workers.

Although the racketeering charges against Mohawk Industries Inc. will now go forward in district court, the ruling from Atlanta’s U.S. Court of Appeals for the Eleventh Circuit also dealt a setback to the plaintiffs, crushing their charges of unjust enrichment.
