Kids' Climate Suit Placed On Hold For 9th Circ. Review

Law360 (November 21, 2018, 9:10 PM EST) -- An Oregon federal judge on Wednesday reluctantly stayed a high-profile lawsuit brought by children accusing the federal government of making climate change worse, fully pausing the case so her refusal to dismiss it can be reviewed by the Ninth Circuit, which recently stayed an already-delayed trial in the suit.

In a six-page order, U.S. District Judge Ann Aiken said that staying the case was not a decision she made lightly, and made the case in her order that holding a liability phase trial before an appeal was the right move in the children’s suit claiming the government violated their constitutional rights...
