Calif. Auto Dealers' Breach Suit Against Contractor Gets Pared

Law360 (November 30, 2018, 8:18 PM EST) -- A California federal judge on Thursday partly trimmed Price Simms Auto Group’s amended breach of contract suit alleging a contractor, Candle3 LLC, furnished faulty electrical work and didn’t properly complete projects to convert six of its dealerships to clean energy, saying certain claims still aren’t specific enough.

U.S. District Judge William B. Shubb partially granted Candle3’s motion to dismiss Price Simms’ claims for intentional misrepresentation, negligent misrepresentation, and false promise stemming from a 2016 contract covering various “scopes of work” for installing LED lighting fixtures, HVAC equipment and solar panels at several of their dealerships.
