Ohio Opioid MDL Bellwether Survives Drug Co. Attacks
Law360 (December 19, 2018, 9:05 PM EST) -- An Ohio federal judge on Wednesday cleared a bellwether suit in the multidistrict litigation over the opioid crisis to move forward, largely signing off on a magistrate judge’s recommendation.
U.S. District Judge Dan Aaron Polster allowed Ohio counties to keep suing opioid manufacturers, distributors and pharmacies on conspiracy and several state law claims, as U.S. Magistrate Judge David A. Ruiz recommended in October. However, he did trim two state public nuisance claims.
