Judge Keeps Subclasses In OT Suit Against Logistics Co.

Law360 (January 31, 2019, 10:29 PM EST) -- An Illinois federal judge has rejected a freight logistics company's request to decertify the subclasses he established in a suit accusing it of failing to pay certain employees overtime, saying their claims can be decided collectively despite their day-to-day work differences.

U.S. District Judge Matthew Kennelly on Tuesday told Total Quality Logistics LLC the claims in Brian Hudgins and Jonathan Rondeno's suit would not require too individualized of inquiries to determine whether the logistics account executives' and LAE trainees' work would fall under the Fair Labor Standards Act's administrative exception.
