K-Swiss Declaratory Suit Over Puma Mark Gets Boot

Law360, New York (July 23, 2009, 5:54 PM EDT) -- A federal judge has booted K-Swiss Inc.’s suit asserting that a stripe running along its shoes does not infringe Puma AG Rudolf Dassler Sport’s trademarked “Formstrip” design, ruling that K-Swiss filed the declaratory judgment suit merely to block Puma's choice of forum.
