UnitedHealth Says It Properly Denied Prostheses Under ERISA

Law360 (March 5, 2019, 4:56 PM EST) -- UnitedHealth has asked a California federal judge to rule that its denial of prostheses for two beneficiaries was proper under the Employee Retirement Income Security Act before analyzing the claims on a classwide basis.  

In a motion for summary judgment Monday, the insurer maintained that it followed the procedures set out in David Trujillo's and Deanna Harden’s plans before denying their requested prostheses. The pair needed to show that UnitedHealthcare Services Inc. had abused its discretion when denying their claims and they’ve failed to do so, the motion states.
