Suit By Baluchi's Employees Gets Green Light

Law360, New York (July 31, 2009, 2:18 PM EDT) -- A federal judge has allowed the bulk of a proposed class action against New York Indian restaurant chain Baluchi’s to go forward, keeping alive a suit accusing the business of failing to pay minimum wage, unlawfully appropriating a portion of workers’ tips and failing to pay the proper amount of overtime.

In an order Thursday, Judge Richard J. Sullivan of the U.S. District Court for the Southern District of New York denied a request from Baluchi's to dismiss the claims for lack of subject matter jurisdiction...
