TreeHouse Says Lead Investor 'Inadequate' As Class Rep
Law360 (April 4, 2019, 8:08 PM EDT) -- A Mississippi-based retirement fund is an "inadequate and atypical lead plaintiff" to represent a proposed class of investors claiming TreeHouse Foods misled them in a risky multibillion-dollar acquisition that backfired financially, the company argued.
Deposition testimony by several witnesses on behalf of named plaintiff investor Public Employees' Retirement System of Mississippi, or MSPERS, showed the organization knew little about key documents and other details of the case, Treehouse lawyers said in a filing Wednesday in Illinois federal court opposing the investors' bid for class certification.
TreeHouse argued it is actually MSPERS' attorneys who are driving the action, rather than MSPERS itself....
