Zoll Says Ex-Partners Can't Escape $5M Arbitration Award

Law360 (April 16, 2019, 1:47 PM EDT) -- Zoll Medical Corp. and its subsidiary Advanced Circulatory Systems Inc. sued two AutoMedx executives late Monday, saying they have used their company to shield themselves from liability for a more than $5 million arbitration award stemming from a contract dispute.

The suit claims that when they realized an unfavorable judgment may be coming, AutoMedx CEO James Evans and chairman William Wiesmann took steps to "divert and deplete" AutoMedx's assets, convert the Maryland corporation to a Texas limited liability company to shield their personal assets under Texas law, and file for bankruptcy protection.
