5th Circ. Won't Rethink Encompass' $9.5M Win Against BCBS
Law360 (April 17, 2019, 10:20 PM EDT) -- The Fifth Circuit won’t reconsider its decision to uphold a $9.5 million win for Encompass Office Solutions in a suit accusing BlueCross BlueShield of Louisiana of improperly blacklisting the medical supplier and refusing to pay for its services.
A two-page order released Tuesday denied BCBSLA’s petition for full Fifth Circuit review of a March panel ruling, which affirmed a Texas federal judge’s holding that the insurer was wrong to reject $1.4 million in reimbursement requests and urge doctors to avoid Encompass based on a tip that the company billed for services it didn’t provide.
