9th Circ. Won't Revive Ex-Tribal Atty's Age Bias Case

Law360 (April 22, 2019, 4:14 PM EDT) -- A former attorney for Arizona's Gila River Indian Community waited too long to argue that a tribal court violated his due process rights when it tossed his age discrimination suit against the community and its general counsel, the Ninth Circuit has held.

Because John T. Hestand did not raise the issue of the alleged due process violation when the litigation was before the District of Arizona, the three-judge appellate panel held Friday that it may not now consider the question, according to the opinion.
