Rockford, Ill., Drug Antitrust Suit Beats Renewed Challenge

Law360 (May 3, 2019, 10:59 PM EDT) -- The city of Rockford, Illinois, can continue with drug-related antitrust claims against pharmacy services company Express Scripts and drugmaker Mallinckrodt after an Illinois federal judge rejected a bid by Express Scripts to undo an earlier order allowing the case to proceed.

U.S. District Judge Frederick J. Kapala shot down Express Scripts' arguments that he had "fundamentally misapprehended" Rockford's allegations when he found in January that the city had plausibly alleged a conspiracy among Express Scripts, its related companies and Mallinckrodt ARD Inc. to drastically pump the price of the hormone drug Acthar.
