Wonder Bread Distributors Get Class Cert. In Wage Suit
Law360 (May 9, 2019, 3:07 PM EDT) -- Wonder Bread distributors and drivers in Maryland, New Jersey and Pennsylvania won final certification as a national collective and as individual state classes from a Pennsylvania federal judge this week, letting them advance lawsuits claiming their company misclassified them as independent contractors and improperly denied them overtime.
In an order signed Tuesday and made public Wednesday, U.S. District Judge Wendy Beetlestone granted final certification to a national collective action under the Fair Labor Standards Act, where workers must opt in, and class actions representing workers in each of the three states, where other distributors can opt out of any litigation, settlement...
