7th Circ. Troubled By Short Discovery In Church Plan Case

Law360 (May 15, 2019, 7:34 PM EDT) -- A Seventh Circuit panel on Wednesday raised concerns about a district court's decision to throw out claims that OSF HealthCare System misused the Employee Retirement Income Security Act's church exemption without allowing more time for pertinent discovery.

U.S. Circuit Judge David Hamilton said during oral argument he was troubled that the lower court granted OSF’s motion for summary judgment in September before allowing the workers to depose members of committees who administer the two defined-benefit pension plans at issue in the case.

“Frankly, it puts this whole judgment into some jeopardy as far as I’m concerned,” Judge Hamilton said.
