Prosecutors Evade Cop's Released Expunged Records Suit

Law360 (May 17, 2019, 5:37 PM EDT) -- An internal affairs police officer at a New Jersey military base cannot sue a county prosecutor's office for releasing his expunged criminal records to a patrolman he had investigated because he did not file a tort claim notice within the requisite time frame, a state appeals court said Friday.

The two-judge appellate panel upheld a trial court ruling dismissing the officer's claims against the Monmouth County Prosecutor's Office since he failed to file that notice within 90 days of when the agency released the records on Nov. 10, 2015, which is when his tort claims against the office accrued, as required...
