Teck Says Justices Need To Reexamine CERCLA Liability

Law360 (May 21, 2019, 8:55 PM EDT) -- Teck Resources Ltd. has pleaded with the U.S. Supreme Court to review a decision holding it liable for releasing waste into the Columbia River, saying that Washington state and the Confederated Tribes of the Colville Reservation's efforts to keep the ruling in place aren't supported by the law.

The state and tribe have argued Teck's petition raises many of the same issues as a related Supreme Court petition from 2007 that was denied. But the Vancouver, British Columbia-based mining giant on Monday said the justices have an entirely new legal landscape in which to contextualize its new petition.
