Antitrust Suit Says Merck Blocking Generic Singulair

Law360, New York (August 13, 2009, 3:24 PM EDT) -- A group of drug wholesalers has filed a proposed class action against Merck & Co. Inc., alleging the drugmaker has engaged in anti-competitive tactics to block generic versions of its asthma and allergy drug Singulair.

The complaint, filed Tuesday in the U.S. District Court for the District of New Jersey by Louisiana Wholesale Drug Co. Inc. and others, claims that Merck's scheme has allowed it to maintain monopoly power over Singulair and charge supracompetitive prices for the drug to the wholesalers.
