NY Teachers’ ERISA Suit Against Union, ING Tossed

Law360, New York (September 1, 2009, 6:42 PM EDT) -- Citing lack of jurisdiction, a federal judge has dismissed a proposed class action brought by New York teachers against their union alleging it accepted kickback payments from ING Life Insurance and Annuity Co. in exchange for promoting the company's investment plans.

Judge Naomi Reice Buchwald of the U.S. District Court for the Southern District of New York ruled Monday that the district court lacked subject matter jurisdiction over the governmental annuity plan at the center of the suit.
