Price-Fixing Suit Over First Data ATM Fees Tossed

Law360, New York (September 8, 2009, 1:41 PM EDT) -- A federal judge has dismissed a putative antitrust class action over fees charged by financial institutions in First Data Corp.’s ATM network, ruling that the plaintiffs failed to identify a proper relevant market but giving them room to amend their claims.

Judge Charles R. Breyer of the U.S. District Court for the Northern District of California on Friday rejected a group of ATM customers' claims that once they opened accounts with the banks, they became "locked in" to the ATM networks the banks use.
