NFL Players' StarCaps Claims Not Preempted: 8th Circ.

Law360, New York (September 14, 2009, 4:16 PM EDT) -- A federal appeals court has affirmed a lower court's ruling that state law claims brought by football players against the NFL — alleging the league failed to warn players that taking dietary supplement StarCaps would make them test positive for a banned substance — are not preempted by federal law.

The U.S. Court of Appeals for the Eighth Circuit ruled Friday that the U.S. District Court for the District of Minnesota was right to uphold the players' state law claims against the NFL.
