Bayer Asks Court To Scrap MDL On Aspirin Marketing

Law360, New York (September 16, 2009, 6:48 PM EDT) -- Bayer Healthcare LLC has asked a federal judge in New York to scrap a multidistrict litigation case that accuses the pharmaceutical giant of illegally marketing its combination aspirins as a way to fend off heart and bone disease.

Bayer filed a motion to dismiss the master complaint Sept. 15 in the U.S. District Court for the Eastern District of New York, saying the case should be thrown out because it is in essence a private attempt to enforce a 2009 federal food and drug law....
