Live365's Bid To Halt CRB Rate-Setting Process Nixed

Law360, New York (September 29, 2009, 3:31 PM EDT) -- The Copyright Royalty Board's proceeding to determine Internet radio royalty rates through 2015 will go forward as planned, despite a bid to postpone the process filed by an online radio network suing over the tribunal's allegedly unconstitutionally appointed judges.

Judge Reggie B. Walton denied Live365 Inc.'s motion for a preliminary injunction on Monday in the U.S. District Court for the District of Columbia, a day before petitioners are scheduled to file their written case statements in the rate-setting proceeding.
