Cingular Prevails In Dispute Over Wash. Surcharge

Law360, New York (October 6, 2009, 3:38 PM EDT) -- A federal judge has thrown out a putative class action accusing Cingular Wireless LLC, now AT&T Mobility LLC, of breaching its contract with customers by billing a surcharge to cover taxes assessed by Washington state.

Judge Thomas Zilly of the U.S. District Court for the Western District of Washington on Friday granted the company summary judgment in the case and dismissed the suit with prejudice.
