Judge Clears Another Trademark Suit Vs. Google

Law360, New York (April 12, 2004, 12:00 AM EDT) -- Another trademark lawsuit against Google is set to go to court after a U.S. District Court judge in New York refused to dismiss the case.

U.S. Judge Denis Hurley has refused to rule on whether “Pets Warehouse” is a generic mark, paving the way for another courtroom battle over Google’s controversial “AdWords” program.

Robert Novak, former owner of PetsWarehouse.com, alleges that Google, along with search engines Overture and Kanoodle, sell his trademarks as keywords to rivals. He sued the three companies in October 2002 for trademark...
