Domino's Pizza Dismissed From FLSA Class Action

Law360, New York (October 19, 2009, 3:03 PM EDT) -- A federal judge has dismissed Domino's Pizza Inc. from a proposed class action alleging the pizza chain and a group of franchisees in New Jersey failed to pay delivery drivers proper overtime wages.

Judge Joel A. Pisano of the U.S. District Court for the District of New Jersey granted the company's motion to dismiss Friday after concluding that the plaintiffs were employees of the franchisee rather than the corporation.
