Covidien Asks 1st Circ. To Hand It Ex-Worker's Device Patents

Law360 (July 16, 2020, 2:20 PM EDT) -- Covidien LP on Wednesday asked the First Circuit to force a former employee of the medical device maker to hand over patent applications he later filed to create an allegedly competing product to treat varicose veins.

The Dublin, Ireland-based company won its breach of contract case against former product director Brady Esch in late 2019, but the federal court in Massachusetts did not order Esch to assign the company three patent applications he filed while at his new venture, Venclose Inc. Covidien has claimed Esch was required to do so under his employment contract.
