3rd Circ. Remands Conspiracy Charge Against Rigases

Law360, New York (October 21, 2009, 4:54 PM EDT) -- A federal appeals court has remanded a conspiracy charge against Adelphia Communications Corp. founder John Rigas and his son Timothy that could have added several years to their prison sentences.

On Wednesday, U.S. Court of Appeals for the Third Circuit judges Julio M. Fuentes and Jane Richards Roth sided with the Rigases, who had sought to dismiss a Philadelphia indictment charging conspiracy to defraud the United States on the grounds that it mirrored the New York charges and thus was barred by the double jeopardy rule....
