US Court Grounds Air Travel Price-Fixing Case

Law360, New York (October 26, 2009, 7:18 PM EDT) -- A federal judge has dismissed a putative class action brought by an American who accused four foreign airlines, including Deutsche Lufthansa AG and Air France, of conspiring to fix the price of air travel between Europe and Japan.

Judge Louis H. Pollak of the U.S. District Court for the Eastern District of Pennsylvania ruled on Oct. 19 that the Foreign Trade Antitrust Improvements Act of 1982 — an amendment to the Sherman Act — excluded the case from the subject matter jurisdiction of the federal courts....
