Pipeline Cleanup Ruling Muddies Precedent, 5th Circ. Told

Law360 (August 31, 2020, 6:12 PM EDT) -- A Texas oil and gas company has urged the Fifth Circuit to reconsider its decision to reverse a $12.7 million lower-court judgment against Total E&P USA Inc. for decommissioning costs of a pipeline system, arguing that the ruling upsets "settled expectations" of who pays for cleanup costs.

In a petition for rehearing Friday, Marubeni Oil & Gas Inc. said the three-judge appellate panel should not have reversed a lower court's summary judgment ruling that Total owed it $12.7 million for the decommissioning costs of a pipeline system associated with abandoned oil and gas wells in the Gulf of Mexico.
