Dell Arbitration Clause Won't Fly In Class Suit: Judge

Law360, New York (October 28, 2009, 7:29 PM EDT) -- A putative class of Dell Inc. consumers has won its bid to toss an order compelling arbitration of its suit over allegedly defective laptop computers, with a federal judge ruling that the arbitration clause and class action waiver of Dell's service agreement are unenforceable.
