Allstate Wants Firm's Fraud Suit Over Expert Witnesses Axed

Law360 (February 22, 2021, 8:21 PM EST) -- Allstate Fire and Casualty Insurance Co. says a Texas personal injury law firm has no evidence to back up its proposed fraud and conspiracy class action that claims Allstate "knowingly" made false representations about three allegedly unqualified expert witnesses the insurer routinely uses.

Allstate argued in a motion to dismiss filed in federal court in Houston on Friday that The Estes Law Firm undercut its own claims with allegations that the insurer routinely hires and uses the three experts despite their affidavits being routinely struck.
