Apple Gift Card Action Survives Dismissal Bid

Law360, New York (December 23, 2009, 2:07 PM EST) -- A federal judge has rejected Apple Inc.'s bid to dismiss a suit claiming it breached a contract with consumers regarding the prices of songs sold through its iTunes gift cards, ruling that the putative consumer class action meets pleading standards established by Twombly.

Judge Michael J. Reagan of the U.S. District Court for the Southern District of Illinois on Monday denied Apple's motion to dismiss the consumer fraud and breach of contract suit.
