Appeals Court Lets Biotech Patent Suit Proceed

Law360 (November 30, 2006, 12:00 AM EST) -- A federal appeals court has denied an immediate interlocutory appeal, allowing Enzo Biochem Inc.’s patent infringement lawsuit against Applera Corp. and Tropix Inc. to go forward in Connecticut.

The U.S. Court of Appeals for the Federal Circuit denied petitions requesting appeal from the Markman rulings issued by the Connecticut district court in October, construing claim terms in six Enzo patents asserted against Applera and Tropix, Enzo said.
