Albright Ships Solar Power IP Suit From Texas To SDNY

By Melissa Angell (October 26, 2021, 8:15 PM EDT) -- FTC Solar can move a patent infringement lawsuit lodged against it over solar technology from Texas to New York after U.S. District Judge Alan Albright found that its license agreement with FCX Solar favors shipping the case off to the Southern District of New York.

Judge Albright observed in his Monday order that the patent license agreement between Texas solar tracking company FTC Solar Inc. and FCX Solar LLC, an engineering consulting firm, names the Southern District of New York as the "exclusive jurisdiction for any matters arising from the agreement's 'subject matter.'"
