Class Cert. Denied In Wells Fargo Overtime Pay Spat

Law360, New York (January 14, 2010, 3:27 PM EST) -- A federal judge has declined to recertify a class of about 7,000 Wells Fargo home mortgage loan consultants in California in an overtime pay dispute, following a federal appeals court's reversal of the district court's initial decision to grant class certification in the case.

Judge Marilyn Hall Patel of the U.S. District Court for the Northern District of California on Tuesday ruled that the U.S. Court of Appeals for the Ninth Circuit left her with little choice but to deny the plaintiff's request for class certification....
