Judge Tosses Action Over Chase ATM Fees

Law360, New York (January 28, 2010, 6:08 PM EST) -- A federal judge has tossed a putative class action alleging that JPMorgan Chase Bank NA violated the Electronic Fund Transfer Act by failing to disclose fees for balance inquiries at the bank's ATMs.

Judge Denis Hurly of the U.S District Court for the Eastern District of New York on Tuesday found that the act did not require Chase to disclose the fees because they were actually charged by Washington Mutual Inc., the plaintiffs' bank, which is now part of Chase.
