Regional GHG Regulation — Full Of Hot Air?

Law360, New York (February 10, 2010, 4:51 PM EST) -- Given the ever-increasing likelihood that Congress will not pass significant cap-and-trade legislation in 2010, states and regions are poised to take center stage in regulatory approaches to greenhouse gas emissions.

In this article, we describe the status of the three regional programs — the Regional Greenhouse Gas Initiative (“RGGI”); the Western Climate Initiative (“WCI”); and the Midwestern Greenhouse Gas Reduction Accord (“MWA”) — as well as California’s climate change regulations. Despite their lofty goals, the implementation of these regional accords has been inconsistent.
