Judge Nixes Callaway Accountants' FLSA Action

Law360, New York (February 9, 2010, 4:56 PM EST) -- A federal judge has scuttled a collective action that accused accounting services firm Callaway Partners LLC of paying out bonuses and compensating partial day weekend work in a manner that violated the salary basis test of the Fair Labor Standards Act.

Judge Clarence Cooper of the U.S. District Court for the Northern District of Georgia signed an order Friday that granted Callaway's motion for summary judgment, saying the bonus plan was bona fide and was not used to facilitate otherwise prohibited deductions from the guaranteed salary....
