Feds Ask Justices To Let $25M Monsanto Roundup Verdict Be

By Dave Simpson (May 10, 2022, 9:31 PM EDT) -- The U.S. Solicitor General urged the U.S. Supreme Court not to take up Monsanto's petition to review a jury's $25 million award over claims that the weedkiller Roundup causes cancer, arguing in an amicus brief Tuesday that the claims aren't barred by federal law.

The Ninth Circuit got it right in May 2021 when it ruled that California's failure-to-warn claims were not preempted by the Federal Insecticide, Fungicide and Rodenticide Act, or FIFRA, as the requirements of both state and federal laws were similarly consistent, the federal government said in its brief.
