J&J Unit Escapes Artificial Disc Negligence Claims

Law360, New York (February 16, 2010, 5:49 PM EST) -- A federal appeals court on Tuesday upheld summary judgment for DePuy Spine Inc. on a customer's claims that the company negligently manufactured a spinal disc replacement product.

A three-judge panel in the U.S. Court of Appeals for the Ninth Circuit ruled that a district court properly granted summary judgment on Camille Carson’s negligent manufacturing claim concerning a Charite Artificial Disc made by DePuy.
