Judge Won't Toss Challenge To Copyright Royalty Board

Law360, New York (February 24, 2010, 7:18 PM EST) -- A federal judge has refused to throw out a lawsuit brought by an Internet radio network that claims that the appointment of judges to the Copyright Royalty Board, which sets the rates webcasters and others pay to digitally stream copyrighted sound recordings, is unconstitutional.

Judge Reggie B. Walton of the U.S. District Court for the District of Columbia signed off on a memorandum opinion on Tuesday denying the government's motion to dismiss for lack of subject matter jurisdiction.
