Ex-Home Depot Asst. Manager Seeks Cert. In OT Suit

Law360, New York (March 15, 2010, 1:05 PM EDT) -- A former Home Depot USA Inc. employee has asked for class certification in a suit accusing the company of deliberately misclassifying assistant managers in training as exempt from the New York Labor Law.

The plaintiff, Christopher Kopera, filed a motion in the U.S. District Court for the Southern District of New York on Friday seeking to certify a class of affected employees at potentially 90 Home Depot stores in the state.
