High Court Keeps Locks Open As Asian Carp Advance

Law360, New York (March 22, 2010, 2:50 PM EDT) -- The U.S. Supreme Court on Monday again refused to issue a preliminary injunction that would have closed locks near Chicago, delivering a blow to Michigan and other states that are desperately trying to prevent Asian carp from reaching the Great Lakes and decimating native fish populations.

The high court justices first denied the preliminary injunction motion on Jan. 19. Soon after, Michigan Attorney General Mike Cox renewed his request for emergency action, pointing to new DNA evidence that showed the invasive fish were likely already present...
